Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hyperscrape platform, websites, and APIs (collectively, the "Service") provided by Hyperscrape, Inc., a subsidiary of its parent company Sense, Inc. ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts

You must provide accurate information when you register and keep it current. You are responsible for all activity under your account and for keeping your credentials and API keys confidential. Notify us promptly of any unauthorized use. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.

2. The Service

Hyperscrape lets you run data-extraction programs ("scrapers"), schedule them, store their outputs, and access those outputs through our API and console. We may add, modify, or remove scrapers and features over time. We aim for high availability but do not guarantee uninterrupted access.

3. Acceptable use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. You are solely responsible for the targets you scrape, the data you collect, and your compliance with all laws and third-party terms that apply to that activity.

4. Your data and content

You retain all rights to the data you extract and the inputs you provide. You grant us a limited license to process and store that content solely to operate and improve the Service. We process personal data as described in our Privacy Policy and, where applicable, our Data Processing Addendum.

5. Credit, fees, and usage

The Service is prepaid: you purchase account credit, and usage is metered in page scrapes — one request to one page — deducted from your balance at the flat rate described on our Pricing page. Purchased credit is non-refundable except where required by law. If you enable auto top-up, you authorize us to charge your saved payment method by the amount you set when your balance falls below your chosen threshold. We may change pricing with reasonable notice; changes apply to usage after the change takes effect.

6. Usage limits

Accounts run on prepaid credit: each page scrape is deducted from your balance, and when it reaches zero, runs are paused until you add credit (or auto top-up recharges it). We may apply reasonable technical limits, including concurrency limits, to protect the Service and other users.

7. Intellectual property

The Service, including its software, scrapers, design, and documentation, is owned by Hyperscrape, Inc. and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, reverse engineer, resell, or create derivative works from the Service except as permitted by law.

8. Third-party services

The Service may rely on third-party providers (for example, hosting, payment processing, and proxy or unlocking infrastructure). Your use of those components through the Service is also subject to the relevant provider's terms where applicable.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SCRAPER WILL SUCCESSFULLY EXTRACT DATA FROM ANY PARTICULAR TARGET.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Hyperscrape, Inc. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You will indemnify and hold Hyperscrape, Inc. harmless from claims, losses, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

12. Suspension and termination

We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, or to comply with law. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice. Your continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Hyperscrape, Inc. is established, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
